John Carpay, president of the Justice Centre for Constitutional Freedoms, testified regarding constitutional litigation undertaken during the COVID-19 period and presented eighteen legislative reform proposals aimed at preventing future rights violations. He stated that while public health legislation is legitimate, governments must implement stronger guardrails to ensure transparency, democratic oversight, and compliance with Charter protections. His recommendations included mandatory disclosure of modelling and data relied upon by chief medical officers, weekly legislative questioning of health officials, automatic expiration of emergency declarations, and required legislative debate and votes for emergency renewals.
Carpay emphasized the constitutional requirement that governments justify any infringement of Charter rights through demonstrable cost–benefit analysis, asserting that this obligation was not properly fulfilled during lockdowns and related measures. He proposed amendments to human rights legislation to prohibit discrimination based on medical treatment decisions, including vaccination status, and advocated statutory civil remedies for individuals coerced into medical procedures. Additional proposals included removing liability protections for pharmaceutical companies, mandating transparency in government contracts, safeguarding medical professional free expression, and preventing undue data collection that could facilitate rights infringements.
He further argued that emergency governance had shifted excessive power to unelected officials and that democratic accountability must be restored through legislative oversight and post-emergency public inquiries. Carpay expressed concern about media influence, judicial deference to government during COVID-related litigation, and the broader cultural acceptance of emergency measures. He characterized his proposals as legislative “guardrails” designed to reduce the likelihood of future large-scale rights violations while preserving constitutional democratic structures.
