Witness Testimony

David Andrew Freiheit, a former litigation lawyer and online commentator known as “Viva Frei,” testified about his firsthand experience attending and livestreaming the Ottawa Trucker Convoy protests in early 2022. He described a pattern in mainstream media coverage that he characterized as ignoring, minimizing, and then demonizing the protest movement. He cited examples of reporting related to alleged Nazi symbolism, desecration of the Terry Fox statue, and claims of misconduct, which he stated were misleading or exaggerated compared to what he observed on the ground.
Freiheit stated that he attended the protest daily, livestreaming events without editing, and reported observing peaceful gatherings, families, veterans, and diverse participants. He testified that he did not personally witness Nazi or Confederate flags beyond widely circulated images from early coverage and that he saw no violence during the protest period prior to police enforcement. He described interviewing both protesters and counter-protesters, highlighting the repetition of political messaging about vaccination consequences.
He further testified that the invocation of the Emergencies Act was unnecessary and disproportionate, stating that negotiations were underway to resolve the protest and that existing laws were sufficient. He described the subsequent police action as forceful and militarized, including arrests, crowd-control tactics, and the presence of multiple police agencies. Freiheit concluded that the protest represented a unifying moment for many participants and that media framing and government response contributed to public misunderstanding of events.
