Witness Testimony

Dr. Ben Sutherland testified that he was employed as a research scientist with Fisheries and Oceans Canada, specializing in marine genomics and serving as co-program head in salmon research. He stated that following the federal government’s announcement of a COVID-19 vaccine mandate in 2021, he attested as unvaccinated and did not seek an exemption. In November 2021, he was placed on administrative leave without pay despite having worked remotely during the pandemic and having received a leadership award for his contributions.
He testified that the leave required him to abandon multiple collaborative research initiatives and disrupted long-term projects and funding arrangements. He applied for Employment Insurance and later established his own genomics consulting company to continue working in the field. Due to conflict-of-interest restrictions associated with his federal employment status, he shifted from salmon genomics to shellfish genomics research. He stated that this transition fundamentally altered his intended scientific career trajectory.
Dr. Sutherland further testified that although the federal vaccine policy was later suspended, it was not formally rescinded, and he chose not to return to his previous position. He initiated a legal challenge in federal court, which remains ongoing. He characterized the consequences of the mandate as significant professionally, financially, and reputationally, and questioned whether the policy objective justified the removal of unvaccinated employees from public service roles.
